These terms govern your use of this website. In short: the site is general information about how healthcare businesses are valued, not advice and not a valuation; reading it or sending an enquiry does not engage HPNA, because an engagement starts only under a separate written agreement; you may read, print and quote the content with attribution but not republish it; and our liability for the site is limited to the extent the law allows.

Who these terms are between

This website is operated by Beach Group Australia Pty Ltd (ABN 17 699 866 718), trading as HPNA, referred to below as HPNA, we or us. These terms apply between HPNA and you, the person using the site.

By using this website you accept these terms. If you do not accept them, do not use the site. These terms cover your use of the website only. A valuation engagement is governed by a separate written agreement, described under "Enquiries do not create an engagement" below.

The website is information, not advice

This website explains how healthcare businesses are valued in Australia. The industry pages, the valuation services pages and the insights articles are general information about how valuation works and about the funding, workforce and regulatory settings that affect value in particular sectors. They are not legal, taxation, accounting or financial advice, and they are not a valuation of your business.

Nothing on the site is an offer capable of acceptance. In publishing it we do not enter a professional relationship with you, and we do not accept responsibility to anyone who reads it and acts on it without engaging us. Anything here that matters to a decision you are making should be confirmed with your own accountant, lawyer or adviser, who can take your circumstances into account. Our disclaimer sets out the limits of the content in full and forms part of these terms.

Enquiries do not create an engagement

Sending an enquiry, attaching documents, emailing us or speaking with us does not create a valuation engagement, a retainer or any other professional relationship, and does not oblige either of us to proceed.

An engagement begins only when HPNA and the person or entity engaging us have agreed, in writing, the business or interest to be valued, the purpose of the valuation, the valuation date, the scope of work, the information to be provided and the fee. The fees published on this site are fixed amounts set by the annual revenue of the business being valued and are quoted exclusive of GST, and the fee that applies to you is the one recorded in that written agreement. How it works describes that process, and request a valuation is where it starts.

Email is not a secure channel. Do not send confidential or sensitive material through this website or by email if you are not comfortable with it travelling that way, and please leave patient, participant and client records out of anything you send us. What we do with what you do send is set out in our privacy policy.

Acceptable use

You may use this website to read, research and contact us. You must not:

  • interfere with the site, or access or attempt to access any part of it that is not made available to you
  • collect content from it by automated means at a rate that degrades it for other users
  • submit false, deceptive or impersonating information through the enquiry form, or attach files containing malicious code
  • use the enquiry form to send advertising or unsolicited commercial material
  • use the site or its content in any way that breaks the law or infringes someone else's rights

Intellectual property

The text, structure, arrangement, design, graphics and logo on this website are owned by HPNA or its licensors and are protected under the Copyright Act 1968 and other laws. Nothing on this site transfers any of those rights to you.

You may read the site, print pages and store copies for your own use, and you may give a copy of a page to your accountant, lawyer or adviser in connection with a valuation you are considering. You may quote a short extract if you attribute it to HPNA and link to the page it came from. You must not republish substantial parts of the site, sell or license the content, or present it as your own work.

This site links to Australian government departments, regulators, legislation and other external sources so that you can check what we say against the original. We do not control those sites, we are not responsible for their content or availability, and a link is not an endorsement of the organisation or of anything else it publishes.

External material changes. A page we cite may be amended, moved or withdrawn after we link to it. Check the date on the source itself before you rely on it.

Availability, accuracy and changes

We do not promise that this website will be available at all times or without interruption, or that it will operate without fault. We may change, suspend or withdraw any part of the site at any time.

We take care to be accurate and we cite the sources we rely on, but the settings this site describes can move. Medicare Benefits Schedule items and bulk billing incentives can be amended, the NDIS Pricing Arrangements and Price Limits can be reissued, pharmacy approval requirements, state pharmacy location and ownership rules and the Pharmaceutical Benefits Scheme can be adjusted, aged care funding and quality standards can be changed, Ahpra registration standards can be revised, and state payroll tax positions on practitioner arrangements can shift. Content is current only as at the published or updated date shown on the page. We are not obliged to update a page after that date, and anything that matters to you should be confirmed against the current source.

Liability and the Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law, which is Schedule 2 to the Competition and Consumer Act 2010, where that guarantee, right or remedy cannot lawfully be excluded, restricted or modified. The Australian Competition and Consumer Commission states that the basic rights covered by consumer guarantees cannot be taken away by anything a business says or does, and that service providers must carry out all services using an acceptable level of care and skill.

Subject to that, and to the extent the law allows:

  • you use this website and its content at your own risk
  • HPNA is not liable for any loss or damage arising from your use of, or your reliance on, this website, including loss of profit, loss of opportunity, loss of data or any indirect or consequential loss
  • HPNA is not liable for loss arising from any external website reached through a link on this site, or from any content, product or service supplied by a third party
  • HPNA is not liable for any failure or delay caused by something outside its reasonable control

Liability for a valuation engagement is dealt with in the engagement agreement for that valuation, not here.

Privacy

Our privacy policy explains what personal information we collect through this website, why we collect it, who we disclose it to and how you can ask for access or correction. It forms part of these terms.

Governing law

These terms are governed by the laws of To be confirmed: state or territory, Australia. You and HPNA submit to the non-exclusive jurisdiction of the courts of that place and of any court that hears appeals from them.

If any part of these terms is unenforceable, it is severed and the rest continues to apply.

Changes to these terms

We may change these terms. The version on this page applies to your use of the site from the date shown at the top. Read them again if it has been a while since your last visit.
